FEBRUARY 2025

  • Criminal Trespass (F2), Terroristic Threats (M1) and Criminal Mischief (M3) - Allegheny: Client facing max sentence of up to 16 years in jail and a permanent felony record. Result: Negotiated agreement for client to pay restitution in return for reduction to summary disorderly conduct.

  • 1st DUI – General Impairment (M) – Fayette: Client facing 6-month max sentence and permanent record upon conviction. Result: Negotiated tentative written offer for future admission into the ARD Program.

  • 1st DUI - Highest Rate of Alcohol (M) - Allegheny: Client facing 72-hour mandatory minimum jail sentence, max sentence of up to 6 months and a 12-month license suspension. Result: Negotiated admission into the ARD program, where client is to complete period of probation and have license suspension reduced to 60 days. Upon successful program completion, all criminal charges will be dismissed and expunged from criminal record.

  • Underage Drinking (S) - Allegheny: Client facing publicly searchable summary conviction that cannot be expunged until client turns 21 years of age along with a $500 fine and costs. Result: Not guilty

  • Retail Theft (M1) - Allegheny: Client facing max sentence of up to 5 years in jail and a permanent record. Result: Negotiated agreement for client to pay restitution and complete educational course in return for a withdrawal of charge.

  • Simple Assault (M2) and Harassment (S) - Allegheny: Client facing max sentence of up to 2 years in jail and a permanent record, along with loss of firearms rights. Result: Charge withdrawn per agreement.

  • Defiant Trespass (M3) - Allegheny: Client facing max sentence of up to 1 year of jail/probation and permanent misdemeanor record. Result: Negotiated reduction to summary trespass offense for fine/costs only.

  • Roadways Laned for Traffic - Westmoreland: CDL holder facing serious traffic violation on driving record. Result: Negotiated agreement to complete safe driving class for full withdrawal of charge.

  • Unlawful Sale/Transfer of Firearm (F3) and Unsworn Falsification to Authorities (M3) - Armstrong: Client facing max sentence of up to 8 years upon conviction and permanent felony record. Guideline ranges on F3 offense carried 21-27 month minimum jail sentence if convicted at trial. Result: Negotiated plea to M3 unsworn falsification. Successfully argued for imposition of 6 months of probation.

  • Underage Drinking (S) - Allegheny: Client facing publicly searchable summary conviction that cannot be expunged until client turns 21 years of age along with a $500 fine and costs. Result: Negotiated agreement for withdrawal of offense, avoiding fines.

  • Speeding 25-29MPH Over Speed Limit – Allegheny: Client facing 5 points. Result: Negotiated reduction to 5mph over, avoiding points.

  • Careless Driving – Allegheny: Client facing 3 points. Result: Negotiated reduction to offense carrying no points.

  • Unlawful Sale/Transfer of Firearm (F3) and Unsworn Falsification to Authorities (M3) - Lawrence: Client facing max sentence of up to 8 years upon conviction and permanent felony record. Result: Negotiated plea to M3 offense at magistrate level for $500 fine and court costs. No probation or jail time, and felony withdrawn.

  • Speeding Greater than 31MPH Over Speed Limit – Allegheny: Client facing 5 points, PennDOT Departmental Hearing and 15-day license suspension upon conviction. Result: Negotiated agreement to reduce speed to 5mph over, no points, suspension or PennDOT hearing.

  • Safe Speed – Allegheny: Client facing 2 points. Result: Negotiated agreement to charge carrying no points.

  • 1st DUI – Highest Rate of Alcohol (M) – Allegheny: Client facing 72-hour mandatory minimum jail sentence, max sentence of up to 6 months in jail and a 12-month license suspension. Result: Client not ARD eligible, but agreement negotiated to complete DUI Alternative to Jail program and 6 months probation.

  • Retail Theft (M1) - Allegheny: Client facing max sentence of up to 5 years in jail and a permanent record. Result: Negotiated agreement for client to pay restitution and complete educational course in return for a reduction to a summary retail theft offense.

  • Reckless Driving – Allegheny: Client facing 6-month license suspension upon conviction. Result: Negotiated reduction to Careless Driving. No license suspension but 3 points imposed.

  • Careless Driving – Allegheny: Client facing 3 points. Result: Negotiated agreement for dismissal of charge.

  • Speeding 45 over and Roadways Laned for Traffic - Allegheny: Client facing 5 points, Penndot Departmental Hearing and 15-day license suspension. Result: Negotiated reduction of speed to 15mph over and withdrawal of roadways laned offense. Points reduced from 5 to 3 and no PennDOT hearing or suspension.

  • Retail Theft (M1) - Allegheny: Client facing max sentence of up to 5 years in jail and a permanent record. Result: Negotiated agreement for client to pay restitution and complete educational course in return for a withdrawal of charge.

  • Possession of Fake ID (S) – Allegheny: Client facing publicly searchable summary conviction that cannot be expunged for minimum period of 5 years along with a $300 fine plus court costs. Result: Negotiated agreement to complete community service in return for a withdrawal of the charge.  

  • Disorderly Conduct (S) and Public Drunkenness (S) - Allegheny: Client facing fines/costs in excess of $600 and publicly searchable summary convictions that cannot be expunged for minimum period of 5 years. Result: Negotiated agreement for client to complete community service in return for withdrawal of charges.

  • Forgery (F3) and Criminal Conspiracy (F3) - Allegheny: Client facing max sentence of up to 7 years in jail and permanent felony record. Result: Negotiated agreement where charges reduced to summary disorderly conduct for fine/costs only.

  • 4x Driving on Suspended License - Allegheny: Client facing 4-year cumulative license suspension upon conviction. Result: Motion to dismiss all charges granted due to violation of statute of limitations.

JANUARY 2025

  • Driving with Suspended Registration - Allegheny: Client facing 90-day license suspension. Result: Negotiated plea to driving without registration, avoiding license suspension.

  • Overtaking School Bus - Allegheny: Client facing 5 points and a 60-day license suspension. Result: Negotiated reduction to offense carrying no points or suspension.

  • Terroristic Threats (F3), Simple Assault (M2) and Criminal Mischief (M3) - Beaver: Client facing max sentence of up to 10 years in jail, a permanent felony record. Result: Negotiated agreement for guilty plea to M3 Criminal Mischief at magistrate’s office for fines, court costs and restitution only. No jail time or probation.

  • Speeding 44mph over and Careless Driving - Allegheny: Client facing 8 points, PennDOT departmental hearing and potential 15-day license suspension. Result: Negotiated reduction in speed to 15mph over and amendment of careless driving to non points offense. 3 points imposed but no license suspension or PennDOT Hearing.

  • 1st DUI - High Rate of Alcohol (M) - Allegheny: Client facing 48-hour mandatory minimum jail sentence, max sentence of up to 6 months and a 12-month license suspension. Result: Negotiated admission into the ARD program, where client is to complete period of probation and have license suspension reduced to 30 days. Upon successful program completion, all criminal charges will be dismissed and expunged from criminal record.

  • Carrying Firearm Without a License (F3) - Allegheny: Client facing max sentence of up to 7 years and a permanent record. Result: Charge withdrawn per agreement.

  • Careless Driving - Allegheny: Client facing 3 points. Result: Charge withdrawn per agreement.

  • Speeding 35mph over - Allegheny: Client facing 5 points, PennDOT Departmental hearing and potential 15-day license suspension. Result: Case dismissed.

  • 1st DUI – Controlled Substances (M) – Butler: Client facing 72-hour mandatory minimum jail sentence, max sentence of up to 6 months and a 12-month license suspension. Result: Negotiated tentative plea offer for admission into the ARD program, where client is to complete period of probation and have license suspension reduced to 60 days. Upon successful program completion, all criminal charges will be dismissed and expunged from criminal record.

  • Accident Involving Damage to Attended Vehicle (M3) - Allegheny: Client facing maximum sentence of up to 12 months in jail and a 12-month license suspension. Result: Negotiated withdrawal of M3 charge with plea to traffic ticket carrying no points or license suspension.

  • Retail Theft (S) – Butler: Client facing max sentence of up to 90 days. Result: Negotiated agreement to pay restitution and complete retail theft educational course for withdrawal.

  • 1st DUI – Highest Rate of Alcohol (M) – Allegheny: Client facing 72-hour mandatory minimum jail sentence, max sentence of up to 6 months in jail and a 12-month license suspension. Result: Client not ARD eligible, but agreement negotiated to complete DUI Alternative to Jail program and 6 months probation.

  • 2nd DUI - Highest Rate of Alcohol with Accident (M1) - Washington: Client facing 90-day mandatory minimum jail sentence, maximum sentence of up to 5 years in jail and an 18-month license suspension. Result: Negotiated plea agreement for 180-days of house arrest and 5 years of probation.

  • Retail Theft (S) - Allegheny: Client facing max sentence of up to 90 days. Result: Negotiated agreement to pay restitution for withdrawal.

  • Fleeing and Eluding (M2) – Fayette: Client facing max sentence of up to 2 years in jail and a mandatory 12-month license suspension upon conviction. Result: Negotiated tentative written offer for admission into the ARD program.

  • 1st DUI - High Rate of Alcohol (M) - Washington: Client facing 48-hour mandatory minimum jail sentence, max sentence of up to 6 months and a 12-month license suspension. Result: Negotiated offer for admission into the ARD program, where client is to complete period of probation and have license suspension reduced to 30 days. Upon successful program completion, all criminal charges will be dismissed and expunged from criminal record.

  • Violating Weight/Size - Beaver: Client facing $13,000 fine upon conviction. Result: Fine reduced to $6500 with client being allowed payment plan.

  • Aggravated Assault - Bodily Injury to Police Officer (F2), Resisting Arrest (M2) & Simple Assault (M2) - Allegheny: Client facing max sentence of up to 12 years in prison and a permanent felony record. Result: Negotiated withdrawal of Aggravated Assault charge at preliminary hearing. At the Court of Common Pleas, negotiated reduction to summary harassment on trial date for summary court costs only. All felonies and misdemeanors were withdrawn.

  • Underage Drinking (S) - Allegheny: Client facing publicly searchable summary conviction that cannot be expunged until client turns 21 years of age along with a $500 fine and costs. Result: Negotiated agreement for withdrawal of offense, avoiding fines.

  • Simple Assault (M2) & Recklessly Endangering Another Person x2 (M2) - Allegheny: Facing max sentence of up to 6 years in jail. Result: Negotiated agreement to complete anger management counseling in return for future reduction to summary harassment and disorderly conduct offenses.

  • Careless Driving - Allegheny: carries 3 points. Result: charge dismissed.

  • Driving w/ Suspended Registration and Driving Unregistered Vehicle - Allegheny: Client plead guilty to charge at magistrate’s office and received 90-day license suspension. Firm hired for summary appeal. Result: Negotiated withdrawal of Suspended Registration charge with plea to unregistered vehicle offense, eliminating 90-day license suspension.
