  • Access Device Fraud (F3), Theft by Deception (M1) and Receiving Stolen Property (M1): Client facing max sentence of up to 12 years in jail and a permanent felony record. Result: Negotiated agreement for client to repay restitution for reduction to summary disorderly conduct.

  • Unlawful Sale/Transfer of Firearm (F3) and Unsworn Falsification (M3) - Beaver: Client facing maximum sentence of up to 8 years in jail and permanent felony record. Result: Negotiated plea to M3 Offense at magistrate level for fines/costs only, no probation. F3 offense withdrawn.

  • Driving on a Suspended License - 6th Offense - Allegheny: Client facing a mandatory minimum jail sentence of 30 days of incarceration, max of up to 6 months, a 12-month license suspension and a $1000 fine. Result: Negotiated reduction to offense carrying no jail time, suspension or points, with fine reduced to $25.

  • Institutional Vandalism (M2) and Public Drunkenness (S): Client facing max sentence of up to 27 months in jail and permanent misdemeanor record. Result: Negotiated agreement for withdrawal of M2 offense and plea to summary public drunkenness for fine/costs only.

  • Retail Theft (S) - Allegheny: Client facing max sentence of up to 90 days in jail and a summary theft conviction that cannot be expunged for a minimum period of 5 years, plus fines/costs of up to approximately $450. Result: Negotiated agreement for client to pay restitution and complete educational course in return for a withdrawal.

  • Speeding 19MPH Over - Allegheny: CDL holder facing 4 points on driving record. Result: Negotiated agreement for client to complete safe driving course for withdrawal of charge.

  • Stalking (M1) and Harassment (M3) - Allegheny: Client facing max sentence of up to 8 years and a permanent record. Result: Agreement negotiated for client to complete treatment in return for a withdrawal of misdemeanor offenses with plea to summary offense only.

JULY 2024

  • Accident Involving Damage to Attended Vehicle (M3) - Allegheny: Client facing maximum sentence of up to 12 months in jail and a 12-month license suspension. Result: Negotiated withdrawal of M3 charge with plea to traffic ticket carrying no points or license suspension.

  • Improper Pass and Fail to Keep Right - Washington: Client plead guilty at MDJ level and 6 points were imposed on driving record. Firm hired for summary appeal proceedings. Result: Negotiated agreement for plea to single traffic offense carrying no points.

  • 3rd Offense DUI - General Impairment w/ Blood Test Refusal (M2) - Washington: Client facing 10-day mandatory minimum jail sentence, max sentence of up to 2 years in jail. Result: Negotiated plea agreement for 30 days of house arrest and 2 years of probation.

  • Reckless Driving and Speeding 39MPH Over - Washington: Client facing a 6.5 month license suspension, PennDOT Departmental hearing and 5 points. Result: Reckless reduced to Careless and Speeding reduced from 39mph to 30MPH. Resolution will avoid mandatory license suspensions and PennDOT Departmental Hearing, but will lead to imposition of 5 points on driving record.

  • 2 Cases - Disorderly Conduct (M3) and Possession of Marijuana (M) and Drug Paraphernalia (M) - Westmoreland: Client facing max sentence of up to 25 months of incarceration and permanent criminal record. Result: Agreement negotiated for client to complete counseling in return for withdrawal of all misdemeanors and plea to 2x summary public drunkenness offenses.

  • Strangulation (F2), Simple Assault (M2) and Harassment - Westmoreland: Client facing max sentence of up to 12 years in jail and a permanent felony record. Result: Negotiated tentative offer for future admission into the ARD program on M2 Simple Assault count. All charges to be dismissed and expunged upon successful completion of the program.

  • 2x counts of Endangering Welfare of a Child (M1) - Beaver: Client facing max sentence of up to 10 years in jail, an permanent criminal record and loss of firearms rights. Result: Negotiated agreement for client to complete counseling in return for a future dismissal of charges.

  • Speeding 55mph Over - Allegheny: Client facing 5 points, a PennDOT Departmental Hearing and a 15-day license suspension. Result: Firm hired for summary appeal of magistrate conviction. Negotiated reduction from 55mph down to 10mph over. Resolution eliminated PennDOT hearing and 15-day suspension, with points being reduced from 5 down to 2.

  • Possession With Intent to Deliver (F), Delivery of a Controlled Substance (F), 2x Possession of a Controlled Substance (M) - Allegheny: Client facing max sentence of up to 14 years in jail and a permanent felony record. Result: Client arrested and incarcerated on a high cash bond. Motion to modify bond was filed, to which court permitted release to alternative housing facility. On preliminary hearing date, EDP plea offer negotiated for Probation Without Verdict on one misdemeanor Drug Possession count, where all other felonies and misdemeanors withdrawn. Upon successful completion of probation, all criminal charges will be dismissed and expunged from criminal record.

  • Driving Without a License - Allegheny: Out of state driver facing potential license suspension upon conviction. Result: Charge dismissed.

  • Access Device Fraud (F3), Unlawful Use of a Computer (F3) and Criminal Attempt (F3) - Allegheny: Client facing max sentence of up to 21 years in jail and a permanent felony record.
